N2 - 横向合并的单边效应是各国反垄断机构审查的重点和核心,以往对单边效应的评估采用传统的结构分析法或合并模拟的方法,但这两种方法都存在着明显的不足。Farrell和Shapiro (2008)提出了一种新的测试单边效应的方法——"价格上涨压力测试法",简称UPP检验。UPP检验建立在直观的经济学原理基础之上,解决了SSNIP测试分析差异产品市场的困难,同时又避免了合并模拟对数据的严格要求。应当通过对UPP检验方法的学习和探讨,丰富我国合并控制反垄断审查的分析工具。 The unilateral effects of horizontal mergers are the focus of attention of anti-trust regulators and agencies. The two methods used traditionally for assessing the unilateral effects are structural analysis and merger simulation. However, these two approaches feature distinct limitations. Farrell and Shapiro (2008) proposed a new method in assessing unilateral effects-upward pricing pressure test (UPP). UPP is based on intuitive economic principles, which solves the problem involved in using SSNIP to test and analyze differentiated products and circumvents the rigid data requirements in merger simulation. This paper aims to expand the toolkit of China’s anti-trust regulation in China by introducing the UPP test to the readership.
